Terms of Service

1. Acceptance of Terms
By accessing or using the Tangerpay API (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Tangerpay provides an application programming interface ("API") that allows authorized users to access data, make changes and perform actions on the Tangerpay configuration and equipment installed at their locations (the "Service"). The Service is provided subject to these Terms and our Privacy Policy.
3. API Access and Authentication
3.1 API Keys
You must obtain a valid API key to access the Service
API keys are tied to your subscription and may have different permission levels
You are responsible for maintaining the confidentiality of your API key
You must not share your API key with unauthorized parties
3.2 Authorized Use
You may only use the API for legitimate business purposes
You must comply with all applicable laws and regulations
You must not attempt to circumvent any security measures or access controls
4. Usage Limits and Restrictions
4.1 Rate Limits
The Service is subject to rate limits as specified in your subscription plan
Exceeding rate limits may result in temporary or permanent suspension of access
Rate limits may be modified at Tangerpay's discretion with reasonable notice
4.2 Prohibited Uses
You must not use the Service to:
Violate any applicable laws or regulations
Infringe upon intellectual property rights of others
Transmit malicious code, viruses, or harmful content
Attempt to gain unauthorized access to systems or data
Reverse engineer, decompile, or attempt to derive source code
Resell or redistribute access to the Service without authorization
Use the Service for competitive intelligence or benchmarking without consent
5. Data and Privacy
5.1 Your Data
You retain ownership of any data you submit through the API
You grant Tangerpay a license to process your data solely to provide the Service
You are responsible for ensuring you have the right to submit any data to the Service
5.2 Payment Customer Data Protection
The Service may provide access to personally identifiable information (PII) of payment customers, including but not limited to email addresses, names, and transaction details
You acknowledge that payment customers have not provided explicit consent for marketing communications
You are strictly prohibited from using payment customer PII for:
Direct marketing or promotional communications
Building marketing databases or contact lists
Sharing with third parties for marketing purposes
Any purpose other than transaction processing, customer service, and legally required record-keeping
You may only use payment customer PII when you have obtained explicit, documented consent from the payment customer for the specific intended use
You must implement appropriate technical and organizational measures to protect payment customer PII
You must comply with all applicable data protection laws including but not limited to GDPR, CCPA, and local privacy regulations
5.3 Our Data
All API responses, documentation, and related materials remain the property of Tangerpay
You may not cache API responses beyond reasonable operational needs
You must not store or retain data beyond what is necessary for your application's functionality
6. Service Availability
6.1 Uptime
Tangerpay strives to maintain high availability but does not guarantee uninterrupted service
Scheduled maintenance will be communicated with reasonable advance notice
Service Level Agreements (SLAs), if any, are specified in your subscription agreement
6.2 Changes to Service
Tangerpay reserves the right to modify, suspend, or discontinue the Service
We will provide reasonable notice of material changes that affect functionality
Continued use of the Service after changes constitutes acceptance of those changes
7. Fees and Payment
Service fees are as specified in your subscription plan
Fees are non-refundable unless otherwise specified
Tangerpay may modify fees with 7 days' notice
Failure to pay fees may result in suspension or termination of access
8. Intellectual Property
8.1 Tangerpay IP
The Service, including all software, documentation, and related materials, is owned by Tangerpay
These Terms do not grant you any intellectual property rights except as explicitly stated
8.2 Feedback
Any feedback, suggestions, or improvements you provide may be used by Tangerpay without obligation
9. Support and Maintenance
Support is provided as specified in your subscription plan
Tangerpay may provide updates, patches, or new versions at its discretion
You are responsible for implementing any required changes to maintain compatibility
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
Tangerpay SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
Tangerpay's TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM
Tangerpay DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED
11. Indemnification
You agree to indemnify and hold harmless Tangerpay from any claims, damages, losses, or expenses arising from:
Your use of the Service
Your violation of these Terms, including any misuse of payment customer PII
Your violation of any applicable laws or third-party rights
Any data you submit through the Service
Any privacy law violations arising from your handling of data obtained through the Service
12. Termination
12.1 Termination by You
You may terminate your use of the Service at any time by discontinuing use and notifying Tangerpay
12.2 Termination by Tangerpay
Tangerpay may suspend or terminate your access for violation of these Terms
Tangerpay may terminate the Service with 7 days' notice
Tangerpay may immediately terminate access due to non-payment of fees, breach of merchant agreements, or suspension of underlying payment processing services
12.3 Automatic Termination
API access is automatically revoked upon termination of any underlying merchant account or payment processing agreement
Termination of merchant relationships by either party results in immediate cessation of API access for that merchant's data
12.4 Effect of Termination
Upon termination, your right to use the Service ceases immediately
You must cease all use of API keys and delete any cached data
Provisions that by their nature should survive termination will remain in effect
13. Compliance and Export Controls
You must comply with all applicable export control laws and regulations
You represent that you are not located in a country subject to trade embargo
You are not listed on any government list of prohibited or restricted parties
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Queensland, Australia
Any disputes will be resolved through binding arbitration in Queensland, Australia
You waive any right to participate in class action lawsuits
15. General Provisions
15.1 Entire Agreement
These Terms constitute the entire agreement between you and Tangerpay
These Terms supersede any prior agreements or understandings
15.2 Severability
If any provision of these Terms is found invalid, the remaining provisions remain in effect
15.3 No Waiver
Failure to enforce any provision does not constitute a waiver of that provision
15.4 Assignment
You may not assign these Terms without Tangerpay's written consent
Tangerpay may assign these Terms without restriction
15.5 Modifications
Tangerpay may modify these Terms with 7 days' notice
Continued use after changes constitutes acceptance
